David Gauke is our new Lord Chancellor, replacing David Lidington. He is the sixth appointment in six years and the first-ever solicitor.

The collapse of Carillion Plc seems set to make a lot of work for a lot of lawyers, with a wake of 450 contractual commitments now to be resolved, and at least one team of unqualified people doing legal work under a now-dubious pending application for ABS status. 

Responding to a Parliamentary Committeee report in November lamenting the declining percentage of judicial appointments from non-barrister backgrounds, the MOJ has acknowledged that cultures among solicitors and within their firms remains averse to Bench aspirations.

Cautionary tales:

-          A solicitor has been struck off for taking clients’ money in payment of disbursements-inclusive bills but then failing to pay the disbursements (eg counsel’s fees);

-          A young solicitor caught with a forged-date carpark pass which he [mis]used on his route to work has paid heavily with a criminal conviction and being struck off;

-          A 30-year old solicitor has been struck off for falsifying insurance documents to help her client escape a debt; and

-          a Manchester solicitor who continued to make outlawed referral fee payments to a claims farmer has been suspended. But

-          A 34-year old employed lawyer has avoided strike off for backdating letters because of the oppressive ‘toxic culture of fear’ within her firm to achieve billing targets.
